LEGAL REGULATION OF SCIENTIFIC ACTIVITY IN UKRAINE IN THE CONTEXT OF THE NEW LAW "ON SCIENTIFIC AND SCIENTIFIC-TECHNICAL ACTIVITY"

The article examines the legal foundations for regulating scientific activity in Ukraine in the context of the adoption of the Law of Ukraine "On Scientific and Scientific-Technical Activity" of November 26, 2015, No. 848-VIII, which replaced the Law of the same name of December 13, 1991, and introduced a fundamentally new model of organizing and financing scientific activity. The main novelties of the Law are analyzed, including the creation of the National Research Foundation of Ukraine as an institution for grant financing of scientific projects on a competitive basis, the introduction of the institute of state attestation of scientific institutions, the determination of the legal status of national academies of sciences as self-governing scientific organizations, as well as the norms on academic freedom and academic integrity. The procedure for the formation and powers of the National Council of Ukraine for the Development of Science and Technology as an advisory body under the Cabinet of Ministers of Ukraine, consisting of scientific and administrative committees, is examined. The legal foundations for basic and competitive (grant) financing of scientific activity under Articles 48–50 of the Law are considered, and the problems of practical implementation of the dual-channel financing model are identified. The provisions of the Law regarding the integration of domestic science into the European Research Area are analyzed, in particular the norms on international scientific cooperation and participation in EU framework programmes. The enshrinement of the principles of academic freedom and academic integrity as fundamental foundations of scientific activity under Article 4 of the Law and the UNESCO Recommendation on the Status of Scientific Researchers of 1974 is examined. The necessity of adopting subordinate regulatory acts, including the Regulation on the National Research Foundation and the procedure for state attestation, to ensure the full implementation of the reforms provided for by the Law is substantiated.References
