LEGAL FOUNDATIONS OF E-GOVERNANCE IMPLEMENTATION IN UKRAINE

The article examines the legal foundations of e-governance implementation in Ukraine as a component of public administration reform and digital transformation of the state. The provisions of the Law of Ukraine "On Electronic Documents and Electronic Document Management" of May 22, 2003, No. 851-IV, and the Law of Ukraine "On Electronic Trust Services" of October 5, 2017, No. 2155-VIII, which replaced the Law "On Electronic Digital Signature" of 2003 and aligned the legal regulation of electronic identification with EU Regulation No. 910/2014 (eIDAS), are analyzed. The Concept for the Development of E-Governance in Ukraine, approved by the Order of the Cabinet of Ministers of Ukraine of September 20, 2017, No. 649-r, is examined and its role in forming strategic priorities for the digitalization of public services is determined. The legal foundations for the functioning of the Unified State Portal of Administrative Services and the system of electronic interaction of state electronic information resources "Trembita" are considered, as well as the Law of Ukraine "On Administrative Services" of September 6, 2012, No. 5203-VI, regarding the provision of services in electronic form. The experience of Estonia as an e-governance leader is analyzed and the possibilities of adapting the Estonian X-Road model to Ukrainian conditions are identified. The necessity of further development of the legal framework for e-governance is substantiated, in particular the legislative enshrinement of the "digital by default" principle and the once-only principle, the expansion of the list of administrative services available in electronic format, as well as ensuring the inclusiveness of digital services for all population categories, including persons with limited Internet access and persons with disabilities.References
