LEGAL STATUS OF SCIENTIFIC INSTITUTIONS IN THE CONTEXT OF THE NAS OF UKRAINE REFORM

The article examines the legal status of scientific institutions of the National Academy of Sciences of Ukraine (NAS of Ukraine) in the context of the reform of the scientific sphere, carried out on the basis of the Law of Ukraine "On Scientific and Scientific-Technical Activity" of November 26, 2015, No. 848-VIII. The provisions of the said Law regarding the legal status of the NAS of Ukraine as a self-governing scientific organization are analyzed, in particular the norms of Articles 17–19, which determine the legal status of national academies of sciences, the powers of their general assemblies and presidiums, as well as the procedure for managing property that is in state ownership and transferred to academies for their activities. The Charter of the NAS of Ukraine, approved by the general assembly and registered with the Ministry of Justice, is examined, and its relationship with the norms of the Law on Scientific Activity and the Civil Code of Ukraine regarding the legal status of legal entities is determined. The problems of the legal regime of property of NAS scientific institutions are considered, in particular the issues of disposing of immovable property assigned to institutions under the right of operational management, and restrictions on the creation of business entities for the commercialization of scientific research results. The requirements of the Law regarding the state attestation of scientific institutions by the National Agency for Higher Education Quality Assurance are analyzed and their impact on the legal status of institutions based on attestation results is determined. The necessity of modernizing the legal status of NAS scientific institutions to ensure their institutional autonomy, financial sustainability and effective commercialization of research results is substantiated.References
