REENGINEERING OF JUDICIAL POWER IN THE CONTEXT OF DIGITAL TRANSFORMATION: MODELS, CHALLENGES, AND LEGAL CONTOURS

Abstract

The article analyzes the process of judicial power reengineering within the context of digital transformation in public administration. It explores the theoretical and methodological foundations of judicial modernization, models of digital justice, and the main challenges accompanying the introduction of technological innovations into the justice system. Reengineering is defined as a comprehensive reform aimed at the structural renewal of the procedural, organizational, and technological architecture of the judiciary. Particular attention is given to three fundamental models of digital justice: the e-justice platform, the paperless court, and AI/ML-based analytical support for judicial decision-making. A comparative analysis of national and international experience (Estonia, Italy, the Netherlands, Singapore) demonstrates that the effectiveness of justice digitalization depends on the level of technological infrastructure, regulatory coherence, and institutional readiness. The study identifies key challenges of judicial reengineering – technological, procedural and legal, organizational and institutional, and cultural and social. It establishes that digital transformation of courts requires harmonization between technological solutions, legal safeguards, and public trust. The article emphasizes that the implementation of digital tools without procedural law reform and proper cybersecurity cannot ensure systemic effectiveness. It concludes that judicial power reengineering should be viewed as a strategic direction of Ukraine's justice development, combining technological efficiency with the principles of the rule of law, transparency, and human oversight over algorithmic decision-making.
