Abstract

The article examines the legal foundations of protecting intellectual property and copyright of scientists in Ukraine, taking into account the specifics of scientific activity as a source of intellectual property objects. The provisions of the Law of Ukraine "On Copyright and Related Rights" of December 23, 1993, No. 3792-XII, regarding the legal protection of scientific works, including articles, monographs, dissertations, reports on scientific research, are analyzed, and the specifics of their legal regime compared to other categories of works are identified. The legal regime of service works created by scientists in connection with the performance of employment duties or at the employer's assignment under Article 16 of the Copyright Law and Article 429 of the Civil Code of Ukraine of January 16, 2003, is examined, and the problems of distribution of copyright between the scientist and the scientific institution are identified. The issues of protecting the right of authorship of scientific results are considered, in particular the problem of so-called "coercive co-authorship" and the procedure for determining the contribution of each co-author of a scientific work. The Berne Convention for the Protection of Literary and Artistic Works of September 9, 1886, and the TRIPS Agreement regarding international standards of copyright protection for scientific works are analyzed. The problems of protecting the copyright of scientists in the context of digitalization of the scientific environment are identified, in particular the lack of clarity regarding the limits of 'reasonably justified scope' of citation under Article 21 of the Copyright Law, and the necessity of improving the legal regulation is substantiated taking into account the specifics of scientific publications, including issues of free use of works for scientific purposes, the legal status of preprints as preliminary versions of scientific articles and the problem of ensuring equal access to scientific publications.
