Abstract

The article examines the legal foundations of ensuring academic integrity as a mechanism for combating plagiarism in scientific and educational activities in Ukraine. The provisions of the Law of Ukraine "On Education" of September 5, 2017, No. 2145-VIII, are analyzed, in particular Article 42, which for the first time at the legislative level defined the concept of academic integrity and established an exhaustive list of its violations, including academic plagiarism, self-plagiarism, fabrication and falsification. The provisions of the Law of Ukraine "On Scientific and Scientific-Technical Activity" of November 26, 2015, No. 848-VIII, regarding mandatory plagiarism checks of dissertations and scientific publications, as well as the powers of the National Agency for Higher Education Quality Assurance (NAQA) in this area, are examined. The relationship between the concept of "academic plagiarism" and the concept of copyright infringement provided by the Law of Ukraine "On Copyright and Related Rights" of December 23, 1993, is considered, and the legal consequences of academic plagiarism as grounds for annulment of the decision on awarding a scientific degree and revocation of a diploma are determined. The Recommendations of the Committee on Publication Ethics (COPE) are analyzed as an international standard of academic integrity in scientific publishing and the degree of their reception by the domestic scientific community is determined. The necessity of improving the legal and institutional framework for academic integrity is substantiated, in particular the unification of plagiarism checking standards, the specification of procedures for handling academic integrity violation cases and the strengthening of the role of the National Agency for Higher Education Quality Assurance, taking into account the development of plagiarism detection technologies, the standards of the Committee on Publication Ethics (COPE) and the requirements of international scientometric databases.
