LEGAL FOUNDATIONS OF OPEN SCIENCE AND OPEN ACCESS TO SCIENTIFIC PUBLICATIONS

The article examines the legal foundations of Open Science and Open Access to scientific publications in the context of domestic and European legislation. The provisions of the Law of Ukraine "On Scientific and Scientific-Technical Activity" of November 26, 2015, No. 848-VIII, regarding ensuring open access to the results of scientific research funded from the state budget are analyzed, and the degree of implementation of open science principles in domestic legislation is determined. The Recommendations of the European Commission on access to and preservation of scientific information of July 17, 2012 (2012/417/EU), as well as the provisions of the Horizon 2020 programme on mandatory open access to publications resulting from programme-funded research are examined. The relationship between the open access principle and copyright is considered, in particular the problem of compatibility of Creative Commons open licenses with the norms of the Law of Ukraine "On Copyright and Related Rights" of December 23, 1993. The Budapest Open Access Initiative of 2002 and the Berlin Declaration on Open Access to Knowledge in the Sciences and Humanities of 2003 are analyzed as programmatic documents of the open science movement and their influence on the formation of legal policy in this area is determined. The necessity of forming a comprehensive legal framework for open access in Ukraine is substantiated, including the normative definition of the legal status of open licenses, the creation of a legal basis for the functioning of institutional repositories and the introduction of mandatory open access to publications created with state budget funds, taking into account the balance between the rights of authors and the public interest in the free dissemination of scientific knowledge.References
