LEGAL MECHANISMS OF INTERNATIONAL SCIENTIFIC COOPERATION UNDER CONDITIONS OF WAR

The article examines the legal mechanisms for ensuring international scientific cooperation under conditions of armed conflict, taking into account Ukraine's experience during the full-scale armed aggression of the Russian Federation. The regulatory framework for international scientific cooperation is analyzed, in particular the provisions of Articles 45 and 66 of the Law of Ukraine "On Scientific and Scientific-Technical Activity" of November 26, 2015, concerning state support for international scientific relations and integration into the European Research Area. The impact of the martial law regime, introduced in Ukraine pursuant to the Decree of the President of Ukraine of February 24, 2022, on the conditions for conducting scientific activities and the freedom of scientific contacts is examined. The sanctions mechanisms in the scientific sphere provided by the Law of Ukraine "On Sanctions" of August 14, 2014, are analyzed, and the necessity of individualizing sanctions against scientific institutions of the aggressor state is substantiated. The legal framework for Ukraine's participation in the EU Horizon Europe framework programme as an associated participant is considered, and its significance for preserving scientific potential under wartime conditions is determined. The export control system provided by the Law of Ukraine "On State Control over International Transfers of Military Goods and Dual-Use Items" of February 20, 2003, is examined, and directions for its improvement with regard to scientific cooperation are identified, in particular concerning the criteria for assessing risks associated with the transfer of fundamental research results. Proposals for forming a comprehensive legal model of international scientific cooperation that combines sanctions restrictions with active development of partnership relations are formulated.References
