ENSURING THE SECURITY OF JUDICIAL POWER AS A CONDITION FOR THE ACCESSIBILITY OF JUSTICE

The article is devoted to the analysis of ensuring the security of judicial power as a key condition for the accessibility of justice and the realization of the right to a fair trial. The aim of the study is to identify the main problems of ensuring the security of judicial power and to develop recommendations for improving legal and organizational mechanisms for protecting judges and other participants in court proceedings. The research employs methods of systematic analysis, comparative legal method, and content analysis of regulatory acts and scientific publications to investigate the relationship between judicial power security and the accessibility of justice. Particular attention is paid to two interrelated components of the accessibility of justice: simplification of court procedures and reduction of court costs. The scientific positions of O. Tkachuk, Yu. Lopanchuk, H. Vlasova, I. Slyvych, V. Bobryk, L. Kondratieva, A. Prokopiuk, and T. Kovalenko on the optimization of court procedures and costs are analyzed. It is established that the effective functioning of the judicial system is impossible without an adequate level of security for judges and other participants in court proceedings, and the lack of adequate protection undermines public confidence in the judicial system. The interconnection and interdependence of simplifying court procedures and reducing court costs as components of the accessibility of justice are proven. The scientific novelty lies in substantiating a comprehensive approach to ensuring the security of judicial power as a prerequisite for realizing the right to a fair trial in the context of European integration processes. The practical significance of the results lies in formulating recommendations for improving law-making and law-enforcement practices in the field of the accessibility of justice.References
