PUBLIC ADMINISTRATION AS A CONCEPT OF MODERNIZATION OF ADMINISTRATIVE LAW OF UKRAINE

Abstract

The article examines public administration as a conceptual framework for the modernization of administrative law in Ukraine within the context of European integration and wartime transformation of public governance. It is substantiated that public administration functions as a systemic legal and organizational principle ensuring the transition from a model of state control to a model of procedural accountability of the state to the citizen. It is proved that the cornerstone of this transformation is the Law of Ukraine "On Administrative Procedure" (No. 2073-IX), which entered into force on December 15, 2023, and established a normative architecture for implementing the right to good administration. The article analyzes the European standards of good administration enshrined in Article 41 of the Charter of Fundamental Rights of the European Union, the SIGMA Principles of Public Administration (2023 edition), and the Recommendation CM/Rec(2007)7 of the Committee of Ministers of the Council of Europe. It is shown that their implementation into the Ukrainian legal order ensures the harmonization of procedural norms and the development of accountability, openness, and procedural fairness. Special attention is paid to the relationship between public administration and the digital transformation of public services: the Diia ecosystem is considered a technical and legal instrument for implementing the principles of transparency, traceability of administrative actions, and legal equality of electronic documents. It is demonstrated that public administration in Ukraine operates not only as a theoretical doctrine but also as a practical mechanism of structural modernization of public governance. It establishes the normative foundation of a service-oriented state in which administrative law guarantees the reasonableness, proportionality, and verifiability of administrative decisions. The introduction of European procedural standards contributes to strengthening public trust in state institutions and consolidating the rule of law. It is concluded that public administration is not merely a reform direction but a conceptual basis for the formation of a modern rule-of-law state in Ukraine, integrated into the European administrative and legal space.
