Abstract

The aim of the study is a comprehensive analysis of the views of Ukrainian scholars who operated within the intellectual environment of the Western Ukrainian lands at the turn of the 19th–20th centuries, as well as in the political writings of the period of the national liberation struggle of 1940–1950, with the goal of identifying the foundations of the national legal tradition and conceptualizing the state as a legal or law-related phenomenon. The research is aimed at determining the axiological content of statehood in the works of Ukrainian thinkers and establishing the relationship between their views and the historical-political context of the time. The study employs historical-legal analysis for examining sources and documents, comparative-historical method for comparing the positions of Ukrainian authors with European trends, and content analysis of political and scholarly texts to identify the value ideals of statehood. This comprehensive approach has allowed for the reconstruction of the evolution of views on the state and law, highlighting the methodological paradigms for determining the value of the state, as well as tracing the dynamics of the development of national legal consciousness. The main findings of the research include the systematization of axiological approaches in the works of M. S. Hrushevskyi, D. Dontsov, P. Poltava, V. Starosolskyi, and other representatives of Ukrainian legal and political thought. It has been found that the direction of their concepts aligned with general European trends but reflected the specifics of the political and historical situation in Ukraine, particularly the issues of state independence, the formation of legal institutions, and the moral foundations of statehood. The scientific novelty of the work lies in the comprehensive study of the axiological discourse of the state in Ukrainian political and legal thought of the 19th–20th centuries and the 1940s–1950s, which makes it possible to establish a connection between the historical situation, value orientations, and the formation of concepts of the state. The practical significance of the work lies in the use of its findings for the contemporary understanding of state and legal institutions of Ukraine, the formation of legal consciousness, and the preparation of scientific, educational, and methodological materials on the history of Ukrainian statehood and law.
